March Madness – March 2, 2021

Please refer to nyall.com for timely updates:Tracking NYS Legislation. Assm. Santabarbara's 1451-A was reported from the Ag committee to codes.  His explanation and that of staff provided committee members a muddled, confused and inaccurate account of the bill and circumstances that motivated him 4 years ago.  Neither he nor counsel could provide a coherent explanation when asked about which party was liable for any mishap.  The bill provides that during an emergency - even a self-declared one - the non-owner of [...]

REVENUE

Congress has given the state of NY a cash bath, a bailout related to the negative impact of Covid -19 and overspending that perennially generates deficits driven by long term public sector settlements the legislature and governor know cannot be met without more taxes or "one shots."  This week's new entry in the one shot sweepstakes is lawsuit filed against Amazon for some sort of neglect of employees safety, health, etc.  Soon litigation settlements will become part of the budget or [...]

JANUARY 29, 2021

Several bills of interest were amended or referred to committees for review. A-1451 - A - The sponsor has replaced the flat version - A-1451 - with one of the earlier prints introduced over the last four year, retaining many of the confusing language and none of the partial improvements from the senate version introduced 3 years ago by Sen. Tedisco.  The measure effectively allows a propane consumer to solely determine if an emergency exists and a dealer, not the owner [...]

Report January 22, 2021

JANUARY 23, 2021 (9:00 AM) New bills introduced this week. S - 2721 - Requires the governor's tax expenditure reporting to include an enumeration of all fossil fuel related tax expenditures; imposes a 5 year expiration upon any fossil fuel related tax expenditures enacted. Yet another sleight of hand maneuver sounding fanciful but simply meaning deductions for the use of fossil fuels, that is money NOT collected as a result of a charge against income, should be stated as "tax expenditures" [...]
